Truck Driver Regulations in New Mexico

Albuquerque 18-Wheeler Accident Attorneys

There are specific laws and qualifications that an individual must meet before they can even get behind the wheel of a semi-truck. Under federal regulations, they must first obtain a commercial driver’s license (CDL). Once they have their CDL license, they are required to follow certain regulations while driving.

What Regulations Must They Follow?

  1. Proper Documentation. A truck driver must be able to show their Driver Vehicle Examination Report at the end of each work day and properly track all of their hours.
  2. Check All Equipment. The driver is responsible for inspecting their truck and making certain that all of its parts are in good working order, as is mandated by federal regulations.
  3. Traffic Violations. Any and all violations must be reported to the truck driver’s employer.
  4. Packing the Truck. All cargo must be secured properly and they must make sure that the truck is not overloaded, both of which could cause horrible accidents.
  5. Maintaining Proper Hours. While truck drivers have schedules and deadlines to meet, they are not to driver more than 11 hours after they have consecutively taken at least 10 hours off duty. Otherwise this can lead to fatigued drivers and potentially lead to a collision.
  6. Cell Phone Use. It is prohibited for anyone carrying a CDL, both bus drivers and truck drivers, to text and drive under FMSCA regulations.

If at any point a truck driver or the trucking company fail to meet these regulations and an accident occurs, they may be liable for any damage caused. The legal team at Goodwin Law Office has over 25 years of experience representing the rights of the injured throughout New Mexico.
